Failure to Maintain Lane

Failure to Maintain Lane - O.C.G.A. § 40-6-48

Failure to Maintain Lane is a very common offense in Georgia. Georgia law requires that all vehicles be driven within a single lane until its driver can safely change lanes. This can include situations where a driver only briefly or slightly crosses over into another lane. Generally speaking, weaving within one’s own lane does not constitute failure to maintain lane. 


Failure to maintain lane cases frequently involve two unique and complicating scenarios: (1) cases involving traffic accidents; and/or (2) cases involving DUI’s. Accident cases are always a bit more complicated than non-accident cases due to concerns about civil liability (i.e. the other driver bringing a personal injury lawsuit against you). In the DUI context, the alleged failure to maintain lane often forms the basis of the traffic stop that gives rise to a DUI investigation. Failure to maintain lane by itself is a three (3) point offense in Georgia.
