Driving Without a License

In Georgia, there are three primary charges relating to licensing. Though tied together by the common thread of driver’s licenses, each offense is different and carries with it very different penalties. These offenses include: 


  1.  Driving With a Suspended License: This is the most severe of the three offenses. This type of offense results in a fine of $500.00 - $1,000.00 and carries with it multiple additional penalties including but not limited to jail time for a first conviction. The penalties increase in severity with each conviction. You can read more in-depth about this here. After a fourth conviction within five years, this becomes a felony.
  2. Driving Without a License: O.C.G.A. § 40-5-20 prohibits individuals from driving without a valid driver’s license. In this scenario, the license is not suspended, the individual charged simply does not have a license period (in any state). After a fourth conviction within five years, this becomes a felony. 
  3. No License on Person: In these types of cases, the driver does have a valid license but simply do not have the physical license on them at the time of the stop.  Georgia law requires drivers in the state to carry their license in their immediate possession while driving. Failure to produce a copy of their license at the request of law enforcement may result in a charge of no license on person. These offenses can often be dismissed with the assistance of a traffic ticket lawyer, but in other situations may result in fines.
